1. These are the terms and conditions (the Terms) on which we (Party Pants)
agree to sell you, (the Buyer) our goods.
2. Goods shall be ordered either by telephone or by email. Our
website does not involve on-line ordering - the purpose of the website is
purely to advertise and promote our goods, and to invite telephone or
email enquiries. For this reason we therefore do not need to have a secure
server as we do not take online credit/debit card details.
3. Goods will be sent to you only after we receive payment. If
payment is by cheque we will send the goods only after the cheque has
cleared. We only accept cheques from UK customers. However, most customers, including UK customers, pay by credit or
debit card.
4. Whilst we take reasonable care to ensure the accuracy of pictures and
descriptions of our goods there may be slight difference between them and
the delivered articles. If you are not satisfied with the goods you may
return them to us within 7 days of receipt for a full refund or exchange.
If you have opened any goods wrapped in transparent packaging we will only
refund those goods if they not been worn or washed by the Buyer (in the
case of clothing, costumes, wigs or accessories) and have not been damaged
by the Buyer. Goods
must be returned in the condition in which you received them to obtain a
full refund or exchange. A full refund does not include postal charges.
Please note that all goods are checked by us before they are
mailed/shipped to you.
5. We shall aim to make refunds within 30 days of us agreeing to give the
refund. Refunds will be made using the original payment method. Postage,
packing and shipping charges paid by you are not subject to a refund.
6. All prices include VAT and are in British Pounds. USA customers will be
quoted prices in dollars if requested. European customers can similarly
request a conversion to euros.
7. Payment for the goods is in accordance with the method selected by
you.
8. We will deliver the goods to the address you have supplied within 2
days of confirming your order, unless you are outside the UK, in which
case you will be given an approximate delivery time. If we are unreasonably late and we are unable to agree an
alternative delivery date with you, you may cancel your order provided you
have not opened the goods. If you do cancel, any advance payment will be
repaid provided the delivered goods are returned to us.
9. We operate a complaints handling procedure which we will use to try to
resolve disputes when they first arise. If you have a complaint contact us

10. You are responsible for ensuring adequate arrangements to take
delivery of the goods. Risk of damage to or loss of the goods shall pass
to you on delivery.
11. You do not own the goods until you have paid for them in full, until
then they remain our property and you must return them to us if we ask you
to.
12. WE SHALL NOT BE LIABLE TO YOU FOR ANY UNFORSEEABLE LOSSES.
13. WE SHALL BE EXCUSED PERFORMANCE OF ANY OF OUR OBLIGATIONS IN RELATION
TO THE GOODS IF CAUSED BY CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL.
CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL WOULD INCLUDE COMMOTION RIOTS, FLOODS, DROUGHT, FIRE AND LEGISLATION.
14. We shall be entitled to cancel the order of goods or suspend delivery
if we are unable to obtain payment.
15. No waiver by either of us of any breach by the other shall be
considered as a waiver of any subsequent breach of the same or any other
provision.
16. If any part of this agreement is held up in Court to be unenforceable
then it shall be considered deleted and not apply but the rest of this
agreement shall apply.
17. This Agreement shall be governed by English laws and English Courts.
18. These terms and conditions do not
affect your statutory rights. |
